This legally binding agreement ("Agreement") is entered into between: Spectrumwise LTD, hereinafter referred to as "Spectrumwise LTD," "we," or "the Company." The undersigned individual(s), hereinafter referred to as "Content Star."

This Agreement ensures compliance with 18 U.S.C. § 2257 and all applicable federal, state, and international laws governing adult content production and distribution.

ELECTRONIC SIGNATURE & CONTENT STAR INFORMATION

By creating an account on Pairwise and checking the mandatory consent box during registration, you are electronically signing this document and providing your legal name, date of birth, and contact information as entered in your profile and verified through our identity verification system. Your verified government-issued ID data (if requested) is securely processed in accordance with our Privacy Policy.

1. CONSENT & ACKNOWLEDGMENT

By electronically accepting this agreement, the Content Star certifies that:

  • All provided information is accurate, truthful, and complete.
  • Any falsification may result in civil and/or criminal penalties.
2. LEGAL COMPLIANCE & SWORN STATEMENTS

Sworn Statement by Content Star

UNDER 28 U.S.C. § 1746 AND PENALTIES OF PERJURY, I swear that: All identification documents provided to the platform are valid, lawfully obtained, and unaltered.

3. TERMS & CONDITIONS

3.1 Ownership & Rights

The Content Star retains full ownership over the created content. Spectrumwise LTD does not claim ownership of any content and acts solely as a hosting service.

3.2 Grant of Limited License

The Content Star grants Spectrumwise LTD a non-exclusive, revocable, and limited license to host, distribute, and display content solely for the purposes of fulfilling its services, subject to this Agreement. This license does not transfer ownership.

3.3 Compliance with Laws

All content must comply with federal, state, and international laws governing adult content.

3.4 Indemnification Clause

The Content Star agrees to indemnify, defend, and hold harmless Spectrumwise LTD, its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, costs, and expenses, including legal fees, arising from:

  • Breach of this Agreement.
  • Any content uploaded, distributed, or monetized.
  • Violations of intellectual property, privacy, or contractual rights.

This indemnification extends to third-party claims, regulatory actions, and law enforcement investigations.

3.5 Force Majeure

Spectrumwise LTD shall not be held liable for any failure or delay in performance due to unforeseen circumstances, including but not limited to natural disasters, government restrictions, cyberattacks, or regulatory changes.

4. DMCA & COPYRIGHT COMPLIANCE

Spectrumwise LTD complies with the DMCA (17 U.S.C. § 512) and follows a Notice-and-Takedown Procedure:

  1. Filing a DMCA Complaint - Email info@spectrumwise.online with a signed notice. Include the copyrighted work's location and proof of ownership.
  2. Content Removal & Review - Spectrumwise LTD will remove content within 24 hours upon receiving a valid notice.
  3. Counter-Notification Process - Users have 10 business days to respond before content is permanently removed.
  4. Repeat Infringer Policy - Users with three (3) or more violations will be permanently banned.
5. COMPLAINTS POLICY

5.2 Resolution Timeline

  • Complaints are acknowledged within 2 business days.

  • All disputes must be resolved through final and binding arbitration.
  • Users waive the right to file class-action lawsuits against Spectrumwise LTD.
  • Arbitration will be held in London, United Kingdom.
